O artigo pretende analisar e sugerir uma saída para o paradoxo democrático, o dilema moral constitutivo entre a soberania nacional do Estado democrático liberal e o reconhecimento dos direitos humanos dos estrangeiros, apontado por Donatella Di Cesare. Para isso, serão reconstruídos o referido paradoxo, a partir das críticas da autora a Michael Walzer e David Miller, e a solução apontada por ela, que envolve a superação da ordem estadocêntrica e a criação de uma comunidade política que não seja centrada na (...) identidade nacional. Em seguida, serão sucessivamente analisadas as posições de tais autores, mostrando-se que as críticas feitas por Di Cesare não correspondem aos trabalhos desenvolvidos por eles sobre comunidade política e identidade nacional. Por fim, será sugerido que há congruências entre esses três autores que poderiam ajudar na construção conceitual de um conceito de comunidade política capaz de oferecer uma direção inicial de saída do paradoxo democrático. Soccer players inescapably live under stress during the sportive career, and many real-life aspects of soccer situations operate in the ongoing performance. This study’s main objective was to elaborate the List of Stressors in Professional Indoor and Field Soccer, a self-report instrument designed to measure the impact of 77 soccer situations upon the sport performance. Participants were 138 indoor and field soccer players from the Brazilian Premier League. Each situation was evaluated on a 7-point scale, ranging from the most negative (...) to the most positive. Data were analyzed according to the players’ perception of the items: distress or eustress and its intensity, and after that, situations perceived as plus −1 and +1 were compared by time in which they were experienced and distributed among five categories established by the literature: Expectations about the Performance, Personal Factors, Competition Aspects, Training Demands, and Relationship with Significant People. Narratives of athletes’ experiences were also used to discuss the results. An Exploratory Structural Equation Modeling using Bi-factorial was employed to assess the factor structure. For the total participants, 49 situations were perceived as distress and 28 as eustress. Using the criteria established a priori, the distribution was among the five categories in the remaining 32 situations. Differences in perception between less and more experienced players were found in 11 situations. The results revealed that Brazilian professional soccer players experience various stressful situations. These events are important representations of environmental demands and could predict the performance as they are perceived as eustress or distress. Some of these stressful situations are inherent in sport and others adjacent to the sports system or environment. Coach pressure to win and conflicts with teammates are examples of stressors in-sport, family problems and disputes with press or fans are examples of stressors external to the team, also called peripheral opponents, and showed the relative social influence of significant others in soccer performance. We can conclude that the knowledge of the direction of a given stress situation has important practical implications in preparing athletes and helping them face the performance stressors that are part of soccer daily life. Soren Kierkegaard's Works of Love, a series of deliberations on the commandment to love one's neighbor, has often been condemned by critics. Here, Ferreira seeks to rehabilitate Works of Love as one of Kierkegaard's most important works. He shows that Kierkegaard's deliberations on love are highly relevant to some important themes in contemporary ethics, including impartiality, duty, equality, mutuality, reciprocity, self-love, sympathy, and sacrifice. Ferreira also argues that Works of Love bears on issues peculiar to a religious ethic, (...) such as the role of God as "middle term," and the possibility of preserving the aesthetic dimensions of love in a religious ethic of relation. Although David Mitrany’s international thought is not usually associated with the concept of the international anarchy, I argue that his analysis actually compares two forms of anarchical order. The first form is the order associated with the relations between states, while the second is his functional alternative to this order. The functional approach is anarchical in the sense that it remains an order without an orderer. In first analysing the dynamics and failings of the inter-state order, and then suggesting pragmatic (...) process-orientated solutions to those failings, I argue that Mitrany follows a similar approach to his classical realist contemporaries. De nos jours, la cote de l'imaginaire est en hausse. Sensibles au mouvement des idees, les historiens se sont mis a la tache. Leurs contributions dans ce domaine ne se denombrent plus. Mais chaque historien affine sa problematique particuliere. Les ponts sont rares entre les epoques et les cultures, et encore plus rares entre les axes differents de recherche. Il existe des imaginaires historiques plutot qu'une veritable histoire de l'imaginaire.Une telle histoire - batie essentiellement sur les structures de l'imaginaire - (...) serait-elle possible? Lucian Boia le croit et essaie de le prouver. Son but est d'identifier certains principes susceptibles d'offrir un minimum de coherence a un domaine pour le moment eclate. Tout en tenant compte d'un large eventail de contributions, ce travail repose en grande partie sur les propres recherches de l'auteur. Envelhecer traz em si significações negativas que se agravam em situação de reclusão. Os procedimentos metodológicos pautaram-se em estudo bibliográfico e pesquisa em banco de dados. Os artigos encontrados foram organizados, analisados, chegando à conclusões como a falta de pesquisas sobre a mulher idosa encarcerada. Por isso, foi realizada a entrevista semi-estruturada com uma senhora sentenciada à privação de liberdade em São Paulo, Brasil. Os dados da pesquisa revelaram que a vida em regime fechado é precária para a mulher idosa (...) e, que se faz necessário repensar as políticas públicas priorizando medidas educativas e artísticas no ambiente prisional. The increasing use of digital technologies in judicial and arbitration proceedings increases the usage of digital evidence by the parties, which brings the necessity of creating patterns for adjudicators to admit and assess this new type of evidence. This paper generally addresses digital evidence focusing on the second moment in international arbitration proceedings. It also narrows the topic to hacked and leaked evidence and its admissibility in international arbitration. The literature review showed a significant amount of research devoted to the (...) evidence in arbitration. Some considered electronic evidence within one jurisdiction; others focused on certain forms of digital evidence such as electronic signatures. Papers on digital evidence in international arbitration approach arbitration rules for digital evidence but skip admissibility issues. No systemic and complex works research digital evidence in arbitration, explicitly focusing on the admissibility of hacked and leaked digital evidence from a comparative perspective. Also, no research deals with enforcing international arbitration awards relying on illegally obtained digital evidence. In these cases, there could be a possible violation of domestic public policy under the New York Convention terms (art. V, 2, b). That is why the paper aims to offer the concept of digital evidence in international arbitration, including hacked and leaked evidence, criteria of its admissibility and relevance, and design the arbitration guidelines for assessing hacked and leaked evidence. Comparative legal analysis of the international arbitration rules and national procedure law allowed us to compare the regulatory approaches to the definition of digital evidence and its admissibility worldwide. The method of legal modeling allowed designing model guidelines for arbitral tribunals to evaluate the admissibility and relevance of digital evidence, including hacked and leaked evidence. Moreover, the case study method allowed us to analyze jurisprudence and define criteria for admission of hacked and leaked evidence. We conclude that the admissibility of hacked and leaked evidence depends solely on the arbitrator’s broad discretion to assess the evidence. Nevertheless, thorough evidence analysis and a well-reasoned award are always mandatory. (shrink)

This study analyzes the most important predictors of acceptance of social network sites in a sample of Chilean elder people. We employ a novelty procedure to explore this phenomenon. This procedure performs apriori segmentation based on gender and generation. It then applies the deep learning technique to identify the predictors by segments. The predictor variables were taken from the literature on the use of social network sites, and an empirical study was carried out by quota sampling with a sample size (...) of 395 older people. The results show different predictors of social network sites considering all the samples, baby boomer males and females, silent males and females. The high heterogeneity among older people is confirmed; this means that dealing with older adults as a uniform set of users of social network sites is a mistake. This study demonstrates that the four segments behave differently, and many diverse variables influence the acceptance of social network sites. (shrink)

Social animals need to share space and resources, whether sexual partners, parents, or food. Sharing is indeed at the core of social life. Humans, however, of all social animals, have distinct ways of sharing. They evolved to become Homo Negotiatus; a species that is prone to bargain and to dispute the value of things until some agreement is reached.

Our goal is to investigate the notion of self-agency in William James and Donald Winnicott. With James, we examine the descriptive element of what constitutes a self. With Winnicott, we explore his explanatory theory on self-emergence. Winnicott's perspective is presented here as the prehistory of the Jamesian self. James's conception of self is similar to the Winnicottian notion of an "integrated self", an embodied position that emerges from the organism's actions in the experiential field. The combination of the two approaches (...) leads to the idea that the self is a flux of identities emerging in interaction with others in the "transitional space" (an intermediate area of experience).
